CONDITIONS OF PARTICIPATION

European Championships of Beerstars competition organised by Insel-Brauerei GmbH

1. SUBJECT MATTER

1.1. These conditions of participation exclusively regulate the participation in the competition "European Championships of Beerstars" of Insel-Brauerei GmbH, Hauptstr. 2c, 18573 Rambin/Rügen, registered at the Stralsund District Court under HRB 8839 ("Inselbrauerei") by the participants as well as the collection and use of the data collected or communicated by the participants.

1.2. By participating in the competition, participants accept these conditions of participation and the data protection regulations.

1.3. Insel-Brauerei GmbH is responsible for the organisation, processing and provision of the prizes and the distribution of prizes.

For the sake of simplicity and for reasons of space, only one specific form (e.g. 'the generic masculine') is used in the following to avoid the use of genders that disrupt the flow of reading, but people of all genders of participants are expressly included.

 

2. CONDITIONS OF PARTICIPATION

 

Participation in the competition is only possible under the conditions listed here. In summary, participation in the competition is dependent on the purchase of goods from the Inselbrauerei, namely a 5-pack plus glass of "5 European Beer Styles" or a 10-pack plus glass of "Euro Paket 10+1" and then as shown in more detail via the QR code of the purchased goods under the link on the Inselbrauerei competition website. " Summarised in detail as follows: 

(1) Participant buys a 5-pack of "European Beer Styles" plus glass" or a 10-pack of "Euro Paket 10+1" plus glass

(2) Via a QR code he lands on our landing page: https://insel-brauerei.de/EM-GroupA orhttps://insel-brauerei.de/EM-GroupB

(3) The participant registers for our newsletter (double opt-IN) and is then taken to another Inselbrauerei competition landing page with the confirmation email

(4) There the participant can award stars to the beers in his 5-pack or 10-pack (1 x 5 stars, 1 x 4 stars,..)

 - The winner will be drawn at the end of the term from the beer with the most votes (winning beer).

2.1. Any legally competent person aged 18 or over and resident in Germany is eligible to take part. Employees of Insel-Brauerei GmbH and employees of cooperation partners who are or were involved in the creation or organisation of the competition and their relatives are excluded.

2.2. Participation in the competition is only possible online and takes place via the website https://insel-brauerei.de/EM-GroupA and https://insel-brauerei.de/EM-GroupB.

2.3. Participation in the competition requires subscription to our newsletter on the website www.insel-brauerei.de.

2.4. Participants in the competition must have an Internet connection and an e-mail address.

2.5. Participation in the competition is free of charge with the exception of the respective individual internet connection costs.

2.6. The participant is always the person who registers for the newsletter with their e-mail address.

 

3. EXPIRY OF THE COMPETITION; TIME PERIOD

3.1. Participation is possible from 15/03/2024, 00:00:00 until 12/07/2024, 23:59:59.

3.2. Participation in the competition is only possible by individuals.

3.3. Insel-Brauerei reserves the right to cancel, interrupt or terminate the competition at any time without prior notice and without giving reasons and to change the conditions of participation at any time for good cause. This right will be exercised in particular if the proper organisation of the game cannot be guaranteed for technical reasons (e.g. computer viruses, system manipulation or hardware/software errors) or for legal reasons.

 

4. EXCLUSION OF PARTICIPANTS

 

4.1. Insel-Brauerei reserves the right to exclude participants from the competition if they manipulate or attempt to manipulate the competition process, provide false information during registration and/or violate legal provisions or the conditions of participation and netiquette. If a prize has already been handed over in such a case, it can be reclaimed if necessary. The organiser also reserves the right to exclude participants who use unauthorised aids or otherwise gain advantages through manipulation (in particular multiple submissions of the same registration). This applies in particular if, for example, automatic scripts, hacker tools, Trojans or viruses are used or if a participant gains an advantage by other unauthorised means.

4.2. Furthermore, untrue personal details and the use of "fake profiles" will lead to exclusion.

4.3. Furthermore, Insel-Brauerei reserves the right to exclude individual participants from taking part in the competition if the username or nickname used by the participant violates the rights of third parties or contains abhorrent, threatening or pornographic content, nudity and/or violence.

4.4. In such cases, prizes may also be subsequently cancelled and/or reclaimed.

 

5. WINNERS, COMPETITION PRIZES AND PRIZE DETERMINATION

 

5.1. A total of 1 winner will be determined.

5.2. The winner will be determined by means of a random draw.

5.3. The prize is 4 days' accommodation in a 4-star hotel on Rügen plus a brewery tour and tasting at Rügener Insel-Brauerei GmbH.

5.4. The winner will be determined after the end of the competition, probably in week 29 2024.

5.5. Cash payment and exchange of prizes are not possible. The claim to a prize or prize substitute cannot be sold or assigned. However, Insel-Brauerei reserves the right to exchange the prize at its reasonable discretion if reasons beyond the control of Insel-Brauerei should force Insel-Brauerei to do so.

5.6. Participants will be notified of the prize by e-mail and asked for confirmation.

5.7. If the winner does not respond with their full postal address within two weeks of the prize notification being sent by email via the email address registered for the competition, the claim to the prize shall lapse. A new winner will then be drawn from the remaining participants. The same conditions apply to the notification of the winner and the acceptance of the prize as for the originally determined winner.

5.8. Premature termination or cancellation of the competition: Insel-Brauerei points out that the availability and function of the competition cannot be guaranteed. The Insel-Brauerei is entitled to cancel, suspend or modify the competition prematurely without this giving rise to any claims by participants against the Insel-Brauerei if unforeseen circumstances arise that are beyond the control of the Insel-Brauerei and make the original implementation more difficult or unreasonable for the Insel-Brauerei. These include, but are not limited to, unauthorised intervention by third parties, technical problems with hardware or software that are beyond the control of Insel-Brauerei, as well as legal violations that are directly related to the implementation of the competition, in particular manipulative intervention in the course of the competition.

 

6. WARRANTY; LIABILITY

Inselbrauerei is released from all obligations when the prize is handed over. Any warranty claims by the winners are excluded in a competition such as this.

6.1. The organiser is not liable for

6.1.1. errors in the transmission of data

6.1.2. theft or destruction as well as unauthorised access to and changes to participant data

6.1.3. technical faults of any kind

6.1.4. damage to the computer of a participant or any other person resulting from participation in the competition.

6.2. The Organiser shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.

6.3. Subject to Sections 7.1 and 7.2, the Organiser shall be liable for the slightly negligent breach of material obligations, the breach of which jeopardises the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the competition and on the observance of which the contractual partners regularly rely. In this case, however, the organiser shall only be liable for foreseeable damage typical of the contract. The Organiser shall not be liable for the slightly negligent breach of obligations other than those specified in the above sentences.

6.4. The above limitations of liability shall not apply in the event of injury to life, limb or health, for a defect following the assumption of quality guarantees for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.

6.5 Insofar as the liability of the organiser is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the organiser.

 

7. DATA PROTECTION INFORMATION

7.1. The organiser collects and uses the participants' data for the purpose of the competition to be held. Any further collection and use of the data shall only take place with the consent of the participants.

7.2. Folgende Daten werden von den Teilnehmern durch den Veranstalter erhoben und dienen der Gestaltung, Durchführung und Abwicklung des Gewinnspiels: E-Mail-Adresse, Adresse, Vor- und Nachname, Geburtsdatum.

7.3. If data must be retained for legal reasons, it will be blocked and deleted after the retention periods under tax and commercial law have expired. The participants' data will not be passed on to third parties for advertising purposes unless the participants have expressly consented to further use. The organiser assures that the participants' data will be treated with the utmost care.

Data processing during participation in the competition serves the sole purpose of organising the competition. The legal basis for the processing of personal data required to fulfil this obligation is therefore Art. 6 para. 1 lit. b) of the EU General Data Protection Regulation (GDPR).

7.4   We analyse the results of the competition in order to measure the efficiency and relevance of the campaign. We determine the success of the competitions in order to continuously improve our marketing activities for the benefit of our customers and to plan new measures. The legal basis for the data processing described above is Article 6(1)(f) of the General Data Protection Regulation (balancing of interests based on our interest in measuring the success of competitions).

 

 

8. FINAL PROVISIONS

8.1. Legal recourse is excluded.

8.2. To the extent permitted by law, the law of the Federal Republic of Germany shall apply, to the exclusion of private international law.

8.3. Should any of these provisions be or become invalid, this shall not affect the validity of the remaining provisions.
